Terms of Service

These Terms of Service ("Terms") govern your access to and use of preciotope.com and related services (the "Service") operated by PrecioTope ("PrecioTope", "we", "us"). By accessing or using the Service, or by creating an account, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
The Service displays historical results of vehicle auctions — such as sale dates, final bid amounts, vehicle descriptions and photos — compiled from publicly available and third-party sources. The Service is provided for general informational purposes only.
We do not sell vehicles, conduct auctions, accept bids, act as a broker or agent, or take part in any transaction between you and any auction, seller or buyer.
2. No affiliation
PrecioTope is an independent service. It is not affiliated with, endorsed, sponsored or approved by Copart, Inc., any other auction house, seller, insurer or vehicle manufacturer. All trademarks, service marks and trade names (including "Copart") belong to their respective owners and are used only to identify the source or subject of the information shown.
3. Information only — not advice
Nothing on the Service is financial, investment, legal, tax, appraisal or mechanical advice, a vehicle valuation, or a recommendation to bid on or buy any vehicle. Past sale prices do not predict future prices. You are solely responsible for your own decisions, and you should independently verify any information (including by inspecting the vehicle and checking its title and history) before bidding, buying or selling.
4. Accuracy of data
Auction data is supplied by third parties and may be incomplete, delayed, inaccurate or changed after publication. We do not verify it and do not guarantee its accuracy, completeness or timeliness.
Unless expressly stated otherwise, a "final bid" or "final price" is the reported winning bid amount and does not include buyer fees, auction fees, taxes, title, storage, transport or any other cost. A sale may have been cancelled, reversed or not completed after it was recorded. Photos are provided as published by third parties, may be illustrative, and may not reflect a vehicle's condition at the time of sale or today. Vehicle identification numbers may be partially hidden.
5. Your responsibility as a buyer
The Service is a research tool. It helps you look up information; it does not tell you whether to buy a vehicle or how much to pay. Buying vehicles at auction involves significant risk, especially for first-time or inexperienced buyers, and you use the Service at your own risk whatever your level of experience.
Before bidding on or buying any vehicle, it is solely your responsibility to: (a) inspect the vehicle in person or have it inspected by a qualified mechanic; (b) verify its title, title brand, liens, odometer and history with the official titling agency and other sources; (c) read and accept the rules, fees and terms of the auction or seller, which are separate from these Terms and which we do not control; (d) confirm that the vehicle can be registered, insured, imported or driven where you intend to use it; and (e) estimate the full cost, including auction and buyer fees, taxes, title and registration, storage, transport, repairs and parts.
Vehicles sold at auction are usually sold "as is, where is", without warranty, and may have hidden damage, missing parts, mechanical or electrical problems, flood or fire damage, deployed airbags, frame damage or title restrictions that are not visible in photos or data. Past sale prices, similar-sale comparisons, match percentages and other figures on the Service describe other vehicles and past events; they are not an appraisal of any vehicle and do not predict what you will pay or what a vehicle is worth.
PrecioTope is not responsible for any loss, cost or damage resulting from your decision to bid on, buy, sell, repair, register or drive a vehicle, including losses caused by your inexperience, by not inspecting the vehicle, by not verifying its title or history, or by relying on information from the Service.
6. Vehicle reports and third-party providers
Vehicle history reports and similar reports offered through the Service are obtained from independent third-party providers. We do not create, control or verify their content. The providers we use, and the content, format, coverage and availability of their reports, may change at any time and without notice, including because of provider availability, pricing or other business reasons. We do not guarantee that any particular report, provider or data point will be available.
A report request may not be fulfilled immediately and may be subject to processing or waiting times, delays or failures caused by the provider or by circumstances beyond our control. Report data may be incomplete or inaccurate, and the absence of a record (for example, of an accident, damage or title brand) does not mean it did not occur. We are not responsible for errors, omissions, delays or unavailability of third-party reports.
Reports are not consumer credit reports and must not be used, in whole or in part, to decide anyone's eligibility for credit, insurance, employment or housing. Reports and other information from the Service may not be used to determine a vehicle's insured or market value, to settle insurance claims or for underwriting.
7. Automated and AI-assisted analysis
The Service uses automated systems, including artificial intelligence ("AI"), to process and display vehicle images and to generate damage assessments, scores or similar indicators ("Automated Analysis"). Automated Analysis is an estimate produced by software from the images and data available to it. It is not 100% accurate, may miss, misidentify or misjudge damage, and can be affected by image quality, angle, lighting and missing images.
Automated Analysis is not an inspection, appraisal or professional opinion, and under no circumstances is it a substitute for an in-person inspection of the vehicle by a qualified professional. You should not rely on Automated Analysis as the sole or primary basis for any decision, including to bid on, buy, sell or value a vehicle, and you assume all risk of doing so.
The same applies to similarity rankings, match percentages, "similar sales" comparisons, price statistics and any other figure the Service computes automatically: they are approximations produced by software from incomplete data, not appraisals, and they may leave out relevant vehicles or include vehicles that are not truly comparable.
8. Accounts
Some features, such as viewing final prices, require a free account. Accounts are provided through a third-party authentication provider. You agree to provide accurate information, to keep your sign-in credentials secure, and that you are responsible for all activity under your account. You must be at least 18 years old to create an account.
We may suspend or close any account at any time, with or without notice, including for a violation of these Terms. If we close your account because you violated these Terms (including fraud, abuse of refunds or chargebacks, or misuse of reports), any unused credits are forfeited and the current subscription period is not refunded, to the extent permitted by law.
You are responsible for all activity, purchases and charges made through your account. Keep your sign-in methods secure and notify us immediately at [email protected] if you believe your account has been used without your permission.
9. Payments, subscriptions and refunds
Some features of the Service may require payment, including individual vehicle (VIN) reports, subscriptions, and prepaid credits (1 credit = US$1, minimum purchase of 10 credits) kept in your account balance. Each credit purchase includes a processing fee. Prices, the processing fee and what each purchase includes are shown before you pay. Payments are processed by a third-party payment processor; by paying you authorize us and our processor to charge your selected payment method, including any applicable taxes.
Vehicle (VIN) reports: the credits or payment used for a vehicle report are final and non-refundable once the report has been delivered (made available to view or download), including where the report contains limited information or delivery was delayed within the waiting times described in section 6. Exceptions: (a) if a report cannot be delivered because of a technical failure on our side or the provider's and it is not fixed within 48 hours, the credits or payment used for it are returned; (b) if you accidentally buy the same report for the same VIN more than once within 7 days, the duplicate is returned. Requests under these exceptions must be sent in writing to [email protected] within 7 days of the purchase.
Prepaid credits: unused credits are refundable in full at US$1 per credit, only to the extent they remain available in your balance and have not been used to pay for any service. You can request a refund of available credits from your account, for an individual purchase or for all available credits, and it is sent to the payment method used for that purchase. Credits used to pay for a service are non-refundable. If a refund to the original payment method is not possible, we may issue it by another method.
Taxes: sales taxes, VAT and any other taxes charged on a purchase are not refundable under any circumstances, including when the credits, subscription or report they were charged on are refunded.
Processing fees: each credit purchase includes a processing fee, shown before you pay, that covers the fee charged by our payment processor. The processing fee is not refundable. When credits are refunded, the refund equals the number of credits refunded multiplied by US$1; the processing fee and any taxes paid on that purchase are not refunded. The exact amount you will receive is shown before you confirm the refund.
Subscriptions: subscriptions renew automatically at the end of each billing cycle at the then-current price until you cancel. A subscription payment is refundable only if you request the refund within three (3) days after the payment was made, whether it was the initial payment or an automatic renewal; in that case, only the most recent billing cycle paid is refunded. After that three-day period, subscription payments are non-refundable. You may cancel at any time to stop future renewals; after cancelling, you keep access until the end of the billing cycle already paid. Every account starts on the free Basic plan. Upgrading to a higher plan takes effect immediately: you receive a credit for the unused time of your current plan, are charged for the remaining time of the billing cycle on the new plan (prorated to the second, plus applicable taxes), and the exact amount is shown before you confirm. Downgrading to a lower plan, including to the free plan, takes effect at the start of your next billing cycle; the current cycle is not refunded or prorated. We may change subscription prices by notifying you by email at least 30 days in advance; the new price applies from the first renewal after that notice period, and you may cancel before it takes effect if you do not agree.
Except as stated in this section or where a refund is required by law, all payments are non-refundable. To request a refund, contact [email protected] from the email address on your account. Approved refunds are issued to the original payment method; the time it takes to appear depends on your payment provider. If you dispute a charge with your bank or card issuer instead of contacting us, we may suspend your account while the dispute is resolved.
10. Acceptable use
You agree not to: (a) scrape, crawl, harvest or otherwise collect data from the Service by automated means, or use bots or scripts to access it; (b) copy, republish, resell, license or commercially exploit data from the Service, or use it to build a competing product or dataset; (c) bypass, disable or interfere with any access control, rate limit or security feature, including the sign-in requirement for prices; (d) share your account or credentials with others; (e) reverse engineer or attempt to access non-public parts of the Service; (f) overload or disrupt the Service or its infrastructure; or (g) use the Service for any unlawful, fraudulent or misleading purpose.
Reports you buy are licensed to you for your own personal, non-commercial use in connection with the specific vehicle (VIN) they were bought for. You may not copy, share, publish, resell, sublicense or otherwise distribute a report or its content, use it to build a competing product or database, or remove any notice from it.
11. Intellectual property
The Service, including its design, software, text, graphics, logos, and the selection, arrangement and compilation of data, is owned by PrecioTope or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own personal, non-commercial purposes. No other right is granted.
Copyright complaints: if you believe that content shown on the Service (for example, a vehicle photo) infringes your copyright, email [email protected] with your contact details, a description of the work, the address (URL) of the content, and a statement that you believe in good faith the use is not authorized and that your notice is accurate. We will review it and, where appropriate, remove or disable access to the content.
12. Third-party services and links
The Service relies on and may link to third-party websites and services (for example, sign-in, content delivery and auction websites). We do not control and are not responsible for their content, availability, terms or privacy practices. Your use of them is at your own risk and subject to their terms.
13. Disclaimer of warranties
THE SERVICE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY DATA IS CORRECT OR CURRENT.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PRECIOTOPE AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS — INCLUDING ANY LOSS FROM BIDDING ON, BUYING, SELLING OR VALUING A VEHICLE IN RELIANCE ON INFORMATION FROM THE SERVICE, ON THIRD-PARTY REPORTS OR ON AUTOMATED OR AI-GENERATED ANALYSIS, AND ANY DELAY OR UNAVAILABILITY OF A REPORT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
We are not liable for any delay or failure caused by events beyond our reasonable control, including outages or errors of data providers, payment processors, hosting or network providers, cyberattacks or unauthorized access to data, acts of government, natural disasters, epidemics or labor disputes. Except for the refunds described in section 9, your sole and exclusive remedy if you are dissatisfied with the Service is to stop using it.
15. Indemnification
You agree to defend, indemnify and hold harmless PrecioTope and its owners, operators, employees and contractors from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
16. Notices and electronic communications
We may send notices about your account, purchases, subscriptions and changes to these Terms to the email address on your account; they take effect when sent. You agree to receive these communications electronically and that they satisfy any requirement that they be in writing. Keep your email address up to date — you are responsible for notices you miss because it is out of date. Notices to us must be sent to [email protected].
17. Changes and termination
We may change, suspend or discontinue all or part of the Service at any time without liability. We may update these Terms; the "Last updated" date shows the latest version, and for material changes we will also notify you by email or on the Service before they take effect. Your continued use after an update means you accept it.
You may stop using the Service at any time and may ask us to delete your account. Sections that by their nature should survive termination (including 3, 4, 5, 6, 7, 9, 11, 13, 14 and 15) will survive.
18. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them. If a translation of these Terms conflicts with the English version, the English version controls.
